An auto-updater allows a program to install arbitrary code on your system,
so I'd think that one that can't be disabled or is "on" by default would
be a spyware issue, too. That's not to say that all such software *is
spyware, but that each user should be able to decide for herself whether
she wants to enable this back door into her system.
